Terms of Service
Please read these Terms of Service carefully before using AmenitySOS. By accessing or using our platform, you agree to be bound by these terms. If you do not agree, you may not use the service.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of AmenitySOS ("Service"), operated by MMN AI, LLC ("Company", "we", "us", or "our"). By creating an account, accessing the Service, or using any feature of AmenitySOS, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you are using the Service on behalf of a property management company or other organization, you represent that you have the authority to bind that organization to these Terms, and references to "you" include both you and that organization.
2. Service Description
AmenitySOS is an AI-powered property maintenance triage platform that provides the following capabilities:
- Automated voice-based maintenance intake via AI ("Aria") that answers tenant calls 24/7
- AI classification, severity scoring, and triage of maintenance issues
- SMS-based media upload for tenants to submit photos and videos
- A staff dashboard for reviewing AI assessments and approving technician dispatch
- Technician and contractor management tools
- AI performance analytics and reporting
The Service is currently in early access. Features, pricing, and availability are subject to change. We will make reasonable efforts to notify registered users of significant changes.
3. Accounts & Access
To use AmenitySOS, you must create an account using a valid email address and authenticate via a supported provider (such as Google OAuth). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to:
- Provide accurate and current account information
- Notify us immediately of any unauthorized use of your account
- Not share your login credentials with unauthorized parties
- Not create multiple accounts to circumvent usage restrictions
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are engaged in fraudulent or harmful activity.
4. Acceptable Use
You may use AmenitySOS only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service to submit false, misleading, or fraudulent maintenance requests
- Attempt to reverse engineer, decompile, or extract source code from the platform
- Use the Service to transmit spam, malware, or any harmful content
- Interfere with or disrupt the integrity or performance of the Service
- Access the Service through automated means without our written consent
- Resell or sublicense access to the Service without authorization
- Use the Service in any way that violates applicable local, state, or federal law
5. AI Limitations & Human Oversight
AmenitySOS uses artificial intelligence to assist with maintenance triage and classification. You acknowledge and agree that:
- AI assessments are advisory only. All dispatch decisions require explicit human approval by authorized staff. The AI does not autonomously dispatch technicians.
- AI may make errors. Severity scores, classifications, and confidence ratings are AI-generated estimates and may not always be accurate.
- You are responsible for dispatch decisions. The Company is not liable for outcomes resulting from staff dispatch decisions made using AI-generated assessments.
- Emergency situations require immediate action. If a tenant reports a life-threatening emergency, staff should contact emergency services (911) directly and not rely solely on the AI triage workflow.
Important: AmenitySOS is a triage and dispatch management tool. It does not replace the judgment of qualified property management professionals or licensed contractors. Never delay emergency response in favor of completing an AI workflow.
6. Data & Privacy
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect personal information. By using AmenitySOS, you consent to the data practices described in our Privacy Policy.
You retain ownership of all data you submit to the Service, including tenant information, maintenance records, and media uploads. You grant us a limited license to process and store this data solely for the purpose of providing the Service.
You are responsible for ensuring that your use of tenant data complies with applicable privacy laws, including any applicable state tenant protection regulations.
7. SMS Communications
AmenitySOS uses SMS messaging to communicate with tenants as part of the maintenance intake workflow, including sending media upload links and confirmation messages. By using the Service, you represent that:
- You have obtained appropriate consent from tenants to receive SMS communications from your property management company via the AmenitySOS platform
- You will maintain records of tenant consent as required by applicable law
- You will provide tenants with a clear opt-out mechanism for marketing communications
- Transactional messages related to active maintenance requests are sent as part of the service and are not marketing communications
Message and data rates may apply to tenants receiving SMS messages. AmenitySOS is not responsible for carrier charges incurred by tenants.
8. Limitation of Liability
To the fullest extent permitted by applicable law, the Company and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Service.
The Company's total liability to you for any claims arising under these Terms shall not exceed the amounts paid by you to the Company in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your dispatch decisions or actions taken based on AI-generated assessments
- Any claims by tenants or third parties related to your use of the platform
10. Termination
Either party may terminate these Terms at any time. You may terminate your account by contacting us at support@amenitysos.com. We may terminate or suspend your access to the Service immediately, without prior notice, if we reasonably believe you have violated these Terms.
Upon termination, your right to use the Service ceases immediately. We will retain your data for a period of 30 days following termination, after which it may be deleted. You may request an export of your data prior to deletion.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email or a prominent notice within the platform at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
